1. Agreement to these terms

This website is operated by KA Method®, owned and operated by its founder, Katherine Anne Kaplan ("KA Method®", "we", "us", "our"). By accessing or using this website, booking a session, registering interest in or enrolling in a training, or purchasing any product or service offered here, you ("you", "the client", "the student") agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website or our services.

2. Nature of our services — important health disclaimer

The KA Method® is a complementary energy healing modality intended to support personal and spiritual growth and general wellbeing. It is not a medical, psychological, or psychiatric treatment of any kind.

You acknowledge and agree that:

• The KA Method® and its facilitators do not diagnose, treat, cure, or prevent any disease, illness, injury, or medical or mental health condition;
• Nothing on this website, and nothing communicated in any session or training, constitutes medical, psychological, legal, or financial advice;
• Our services are not a substitute for professional medical or mental health care. You should always consult a qualified healthcare provider regarding any health concern, and you should never delay, discontinue, or modify any medical treatment, medication, or therapy on the basis of our services;
• No specific result or outcome is promised or guaranteed. Individual experiences vary, and any accounts of client experiences shared on this website (including testimonials) are individual to those clients and are not a promise of similar results;
• If you are experiencing a medical or mental health emergency, contact your local emergency services immediately.

3. Eligibility

Our services are offered to adults aged 18 and over. Sessions or trainings for anyone under 18 may only proceed with the express written consent of, and arrangement by, a parent or legal guardian, at our discretion.

4. Sessions and bookings

1:1 sessions are offered in person and by distance. When you book a session, you agree to provide accurate information and to arrive (or connect) on time. Payment, rescheduling, and cancellation terms are those presented at the point of booking with the relevant facilitator. Unless otherwise stated at booking, sessions cancelled or rescheduled with less than 24 hours' notice may be charged in full.

5. Independent facilitators

Certified KA Method® facilitators listed on this website (other than the founder) are independent practitioners. They are not employees, agents, or partners of KA Method®. Each facilitator is solely responsible for the sessions they deliver, their own bookings, payments, insurance, and compliance with the laws of their location. Their listing on this website is provided as a directory convenience and does not make us a party to, or responsible for, the services they provide.

6. Trainings and enrolment

Trainings are offered in levels and open periodically in limited cohorts. Registering interest through this website does not constitute enrolment and creates no obligation on either party. Enrolment occurs only upon acceptance into a cohort and payment (or agreed payment plan) under the terms presented at enrolment. Completion of a level does not guarantee acceptance into a subsequent level.

Unless otherwise stated at enrolment: training deposits are non-refundable; withdrawals more than 14 days before a training begins will be refunded less the deposit; and withdrawals within 14 days of the start date are non-refundable, though fees may be credited toward a future cohort at our discretion.

7. Intellectual property, trademark, and certification licence

KA Method® is a registered trademark. The modality itself — including its name, techniques, attunement sequences, light codes, the ten-center soul architecture framework, teaching materials, manuals, recordings, workbooks, curricula, and all associated content on this website — is proprietary intellectual property owned by KA Method® and its founder, and is protected by trademark, copyright, and trade secret laws.

You agree that you will not:

• Copy, reproduce, distribute, publish, record, or share any training materials, in whole or in part, without our prior written consent;
• Teach, certify others in, adapt, rename, or create derivative modalities from the KA Method® or any of its techniques, unless expressly authorised in writing through completion of the applicable level of training and a current teaching authorisation;
• Use the KA Method® name, marks, or emblem in any business name, domain, marketing, or offering except as licensed below.

Certification licence. Certification as a KA Method® practitioner or facilitator grants a personal, non-exclusive, non-transferable, revocable licence to (a) deliver KA Method® sessions to clients and (b) accurately describe yourself as a certified KA Method® practitioner, for so long as your certification remains in good standing. This licence does not permit teaching or certifying others (which requires separate teacher authorisation), and it terminates automatically if certification is suspended, revoked, or lapses. We reserve the right to revoke certification for misrepresentation of the method, breach of these terms, or conduct that harms clients or the reputation of the modality. Upon termination, all use of the KA Method® name and marks must cease.

8. Website content

All content on this website — text, graphics, logos, the KA Method® emblem, images, and design — is our property or used with permission, and may not be reproduced or used without prior written consent, except for personal, non-commercial viewing.

9. Assumption of risk and release

Participation in any session or training is voluntary. To the fullest extent permitted by law, you assume all risk associated with your participation and release KA Method®, its founder, teachers, and staff from any claims, liabilities, damages, or expenses arising from or connected to your participation, except where caused by our proven negligence or wilful misconduct, and except for any liability which cannot be excluded by law.

10. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to this website or our services shall not exceed the amount you paid to us for the service giving rise to the claim. We shall not be liable for indirect, incidental, special, or consequential damages. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including under consumer protection law in your place of residence.

11. Indemnification

You agree to indemnify and hold harmless KA Method® and its founder, teachers, and staff from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the website, or, if you are a certified practitioner, from the sessions and services you independently deliver.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using this website you consent to that handling. If you are located in the EU/EEA or UK, you have the rights afforded by applicable data protection law.

13. Third-party links and booking

This website contains links to third-party websites, including facilitators' own booking pages. We are not responsible for the content, terms, or privacy practices of third-party sites, and linking does not imply endorsement.

14. Changes to these terms

We may update these Terms & Conditions from time to time. The version published on this page, with its "last updated" date, is the version in force. Continued use of the website or services after changes are published constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles, and any disputes shall be subject to the exclusive jurisdiction of the courts of that place, except where the mandatory consumer law of your country of residence provides otherwise.
